1.1 The services and offers as well as all contracts concluded with customers by ixxalp – Touristik und Event GmbH, Zwölferkogelweg 121, 5754 Hinterglemm (hereinafter "IXXALP") are exclusively based on these General Terms and Conditions (GTC), regardless of the type of legal transaction (e.g., booking of events/White Pearl Mountain Days/ticket shop, table reservation at restaurants via IXXALP as intermediary).
1.2 These GTC apply to services in both "B2B" and "B2C" areas.
1.3 All private-law declarations of intent by IXXALP are to be understood on the basis of these GTC.
1.4 Conflicting or deviating conditions of customers shall not apply unless IXXALP has expressly agreed to their validity in writing.
1.5 Contract fulfillment actions by IXXALP do not constitute acceptance of contract terms deviating from these GTC.
1.6 These GTC also serve as a framework agreement for all further legal transactions between the contracting parties.
2.1 The product descriptions contained in the IXXALP ticket shop do not constitute binding offers by IXXALP to conclude a (purchase) contract. They merely invite the customer to submit an offer by placing an order.
2.2 The order is placed in the following steps:
2.3 By submitting the order in the ticket shop, the customer makes a binding offer aimed at concluding a purchase contract for the goods contained in the shopping cart. IXXALP reserves the right not to accept orders (offers by the customer) without giving reasons. By submitting the order, the customer acknowledges the pre-contractual information for consumers and these GTC as exclusively applicable to the legal relationship with the entrepreneur.
2.4 The entrepreneur (IXXALP) confirms receipt of the customer's order by sending a confirmation email (receipt confirmation). This does not yet constitute acceptance of the customer's offer but only informs the customer that the order has been received. Upon receipt confirmation, the customer also receives all pre-contractual information according to § 4 para. 1 FAGG on a durable medium (by email).
2.5 Acceptance of the offer is declared explicitly or at the latest by sending the tickets. After conclusion of the contract, the customer receives confirmation of the concluded contract on a durable medium (usually by email).
2.6 Order processing and contact take place exclusively by email and automated order processing. The customer must ensure that the email address provided for order processing is correct to receive emails sent by IXXALP. In particular, the customer must ensure that spam filters do not block emails from IXXALP or third parties commissioned for order processing.
3.1 Prices are listed for the respective goods or tickets. Unless otherwise indicated, the prices are gross prices (including statutory VAT and other charges and fees).
3.2 The sale prices of IXXALP do not include shipping costs. For e-tickets, no shipping costs apply—they are sent by email to the address provided during order.
3.3 IXXALP is obligated to perform the service only after the customer has fulfilled all obligations required for execution. Delivery times and dates are non-binding, unless explicitly agreed as binding, and always refer to the expected time of provision and handover to the customer.
4.1 An invoice properly itemized and sent to the customer is deemed approved if the customer does not raise written objections within six weeks of receipt. For entrepreneurs, the timeliness of receipt of the objections by IXXALP is decisive. For consumers, the dispatch of objections is decisive. IXXALP will inform consumers about the importance of their behavior at the start of the period.
4.2 IXXALP reserves the right to send invoices electronically or by post. The customer consents to receiving invoices electronically (e.g., by email, as an email attachment in PDF format).
4.3 If an order is placed by several customers, they are jointly and severally liable for all claims arising from IXXALP. For consumers, this applies only insofar as services are divisible and clearly provided only for one customer.
4.4 In case of default, the customer must pay default interest at the statutory rate (§ 456 UGB for entrepreneurs, § 1000 ABGB for consumers). Further statutory claims remain unaffected. In the event of default, the customer agrees to reimburse reminder and collection fees incurred by IXXALP as far as necessary for effective legal enforcement. For business transactions, a flat rate according to § 458 UGB is payable. Further rights and claims remain unaffected.
5.1 Ixxalp Touristik und Event GmbH is organizer White Pearl Mountain Days. If IXXALP acts as an intermediary, IXXALP points out this fact and the actual contracting party. The contractual relationship is exclusively between the third party and the customer. The contractual terms of the third party apply, with the third party replacing IXXALP as contracting party.
5.2 Entrance to paid events (especially White Pearl Mountain Days) is only possible upon presentation of a valid ticket. A ticket is only valid if it was properly paid and is undamaged.
5.3 The first showing of the ticket entitles a one-time entry. If a valid ticket is not presented—for any reason, including loss or unreadability of the QR code—entry may be refused. There is no claim for refund in such cases.
5.4 After presenting a valid and undamaged ticket, the customer receives a wristband allowing exit and re-entry to the event area. Customers must wear the band throughout the whole event and show it upon request. Failure to show the band may result in exclusion from the event without refund.
5.5 Ticket purchase is possible only via the official booking platform (ticket shop) of IXXALP at https://wpmdays.at/en/book. Tickets sold via other channels or third parties are not recognized by IXXALP. In such cases, there is no right to enter or refund.
5.6 The contract for ticket purchase is concluded exclusively between the customer and IXXALP upon completion of the ordering process (see section 2.3). This is to be distinguished from the reservation of tables with the respective gastronomic establishments made via IXXALP acting as an intermediary (see section 10.1).
5.7 Ticket payment is made exclusively electronically by PayPal or credit card via provided payment services. The booking is considered binding only upon full receipt of payment and completion of the ordering process in accordance with Section 2.3. Unpaid orders will not be processed and will be deleted.
5.8 Tickets are delivered solely digitally by email to the address provided by the customer. Postal shipping is excluded. The customer must bring the ticket in printed or digital form (e.g., on a mobile device) and show it at entry. Without a valid ticket, entry is not permitted.
5.9 The organizer reserves the right to regulate entry times and to restrict or refuse entry after the event has started. There is no entitlement to late entry. Entry times are announced on the website and printed on the tickets. Unless otherwise specified on the ticket, booking confirmation, website, or on-site, entry is allowed only with a valid ticket from the official start of the event up to 1 hour later (e.g., start 11:30 a.m.: entry until 12:30 p.m.). After this period, there is no entitlement to entry or refund. Statutory claims remain unaffected.
5.10 Tickets are non-personalized and transferable. Commercial resale, especially via unauthorized platforms or at inflated prices, is prohibited. The organizer reserves the right to block or invalidate tickets suspected of misuse or manipulation.
5.11 By passing tickets to third parties, the original booking customer transfers all rights and obligations related to event attendance (e.g., compliance with house rules, security, ticket possession) to the receiving person. Notwithstanding this, only the customer who purchased the ticket from IXXALP remains the contractual partner. Refunds, changes, cancellations, and contractual or payment rights apply only to that customer.
5.12 Lost or deleted digital tickets cannot be replaced. The customer is responsible for safely storing the email with the ticket.
5.13 Under § 18 para. 1 no. 10 FAGG, the customer has no right of withdrawal for ticket purchases (see section 8.6).
6.1 By purchasing a ticket, the customer agrees to the applicable house rules and all event-related safety, behavioral, and entry regulations of the organizer. Entry may be refused if a person's behavior endangers safety, order, or smooth event operation, especially in cases of high intoxication, aggression, or similar issues. No refund will be given. The house rules for all White Pearl Mountain Days events apply and are available online: https://wpmdays.at/en/houserules.
6.2 Entry for minors is only permitted with a suitable adult supervisor unless otherwise specified. One supervisor may accompany up to five minors. Applicable youth protection laws apply (primarily age and time limits). Entry may be refused if these are not met. IXXALP may request official photo ID or age verification.
6.3 Ticket obligation: Tickets are required from age 6.
6.4 If the ticket assigns a specific seat or standing place, only that place may be used. Changing seats is not allowed.
6.5 Audio, video, and photographic recordings of performances or artists are prohibited. Visitors may take private, non-commercial photos or videos of themselves or companions only if it does not disturb performances, artists, others visitors or the event flow. Event staff may prohibit recordings in certain areas or situations. Any publication beyond private use, especially for commercial or advertising purposes, is prohibited without written consent of IXXALP.
6.6 Instructions by event staff, particularly entry and security personnel, must be followed without restriction, including security checks at entry or during the event. Violations of house rules or contractual obligations may result in refusal of entry or exclusion from the event without refund.
7.1 It is the visitor’s responsibility to assess their own health condition and any potential risks associated with participating in the event. In particular, it is their responsibility to determine in advance whether, due to individual health conditions, they may have a heightened sensitivity to typical influences of the event.
7.2 The visitor acknowledges in particular that:
7.3 Visitors agree to take appropriate precautions, such as using ear protection, sunglasses or refraining from attendance if necessary.
8.1 IXXALP is only obligated to hold the event as such, including an entertainment program corresponding to the concept. No guarantee of quality or specific artists/performance elements is given. Announcements of program points, artists, schedules, or line-ups are non-binding. Tickets are valid for the booked event day or period regardless of program elements; no claim exists for specific artists. Changes or cancellations of acts do not entitle refunds, ticket exchanges, or replacement claims. Refunds occur only if the entire event day is canceled.
8.2 Due to the long-term planning of events, in particular the White Pearl Mountain Days, IXXALP reserves the right to make organizational changes to the program (e.g., minor changes to the time and duration of the event, relocation of the venue within the local area, changes to the composition of a performing group, partial changes to line-ups, or equivalent modifications). Such changes do not entitle the CUSTOMER to a refund or compensation. There is no entitlement to full or partial performance of the event.
8.3 IXXALP can postpone or cancel events due to: extreme weather or natural disasters; public safety threats (terror warnings, epidemics, pandemics); illness or absence of artists or essential personnel; official orders, measures, or other legal requirements that prohibit or effectively make the execution of the event impossible; serious technical disruptions that significantly affect the proper execution of the event and cannot be remedied in time (e.g., power failure, failure of central event equipment, or similar); or to reschedule individual dates or to cancel the event entirely.
8.4 Customers will be informed timely about program changes, postponements, or cancellations via the website and email. In case of cancellation, IXXALP refunds paid ticket prices only. Liability for expenses such as travel, accommodation, meals, rental cars is excluded except for intent, gross negligence, or personal injury. This applies also to changes or partial cancellations unless explicitly guaranteed in writing. For consumers, additional provisions under point 9.4 apply. For entrepreneur customers, further claims (expenses, travel, accommodation) are excluded.
8.5 Outdoor events may occur in any weather; visitors are responsible for appropriate clothing.
8.6 No Right of Withdrawal for Consumers according to § 11 FAGG. According to § 18 para. 1 no. 10 FAGG, no right of withdrawal exists for contracts for services related to leisure activities with a fixed date or period. This applies to:
The CUSTOMER therefore acknowledges that, in this regard, no right of withdrawal exists under the Austrian Consumer Protection Act (FAGG).
9.1 Warranty for customers who are entrepreneurs according to the KSchG: Warranty period for all services by IXXALP is one year from acceptance unless a shorter period by law or contract applies. § 924 ABGB does not apply.
9.2 Section 9.1 does not apply to consumer transactions. For consumers, the statutory warranty rights and statutory warranty periods shall apply.
9.3 Agreements regarding compensation for damages in relation to the CUSTOMER, who is an enterprise within the meaning of the Austrian Consumer Protection Act (KSchG): Compensation claims are excluded for slight and simple gross negligence, except for personal injury or breach of essential main obligations. The injured party must prove negligence. No liability for indirect damages, loss of profit, interest loss, consequential or third-party claims. IXXALP has liability insurance with coverage of EUR 5,000,000. Liability is limited to insurance coverage. Claims expire one year after knowledge of damage and damaging party.
9.4 Agreements regarding compensation for damages in relation to the CUSTOMER, who is a consumer within the meaning of the Austrian Consumer Protection Act (KSchG): Compensation claims (including indirect or consequential damages) are excluded for slight negligence except for personal injury or breach of essential main obligations (cardinal obligations). This does not apply to damages to items entrusted for processing unless individually negotiated. For slight negligence of cardinal obligations, liability is limited to foreseeable typical contractual damage. Statutory limitation periods apply.
9.5 For breach of essential obligations, IXXALP is liable only for foreseeable, typical damage unless intent or gross negligence exists. For event cancellations, this usually corresponds to the ticket price.
9.6 The limitations of liability under this Section 9 also apply to the liability for vicarious agents of IXXALP.
9.7 The provisions on compensation contained in these Terms and Conditions or otherwise agreed shall also apply if the claim for damages is asserted in addition to or instead of a warranty claim.
10.1 Intermediation Service / Contract partner: IXXALP mediates table reservations at independently operated gastronomy businesses ("restaurateurs") in the event area within the framework of the White Pearl Mountain Days. This is solely a mediation service: IXXALP itself is not the contractual partner for the gastronomic service.
10.2 Contract conclusion for catering: A contract is concluded exclusively between the CUSTOMER and the respective restaurateur by acceptance of the reservation after payment of the deposit (= amount for minimum consumption) or at the latest by the catering of the guest by the restaurateur. The actual provision of the gastronomic service and all associated rights and obligations are governed by the respective restaurateur's provisions. The restaurateur's GTC linked and accepted via checkbox in the reservation process apply to the catering contract. Before concluding the reservation, the customer confirms separately via checkboxes: a) the IXXALP GTC (including mediation) and b) the restaurateur's GTC or the WKO standard conditions used by them for restaurateurs. Time, text version, and consent are stored for evidentiary purposes.
Collision rule: The reservation parameters explicitly stated in the checkout and in these (IXXALP) GTC (date/time, minimum consumption, Moët purchase, ticket obligation, table size, cancellation/no-show) are part of the catering contract and take precedence over deviating provisions of the restaurateur's GTC.
10.3 Liability limitation: In relation to the table reservation at the restaurant, IXXALP acts as mediator and is not liable for refunds by the respective restaurateur. IXXALP assumes no liability for actual fulfillment of the mediated gastronomic service, any defects, changes, delays, or other inconveniences resulting from the contractual relationship between CUSTOMER and restaurateur. Claims are to be made directly against the respective restaurateur.
10.4 Reservation, minimum consumption/deposit, Moët purchase obligation: Tables/seats can only be reserved via the online booking system after agreement and payment of the minimum consumption per person or per table as specified in the booking process.
Additional purchase obligation: The customer undertakes to order the following quantity of bottles on the day of the event:
No additional deposit / crediting towards minimum consumption: No further deposit is owed for the additional purchase. The agreed bottle quantity is considered a binding order on the day of the event; the prices incurred are primarily credited to the agreed minimum consumption. The gross prices of the offered bottle sizes are clearly indicated before concluding the reservation in the booking process. If the price of the agreed bottle quantity exceeds the remaining minimum consumption, the difference must be paid on-site. If the actual total consumption is below the agreed minimum consumption, the minimum consumption remains owed. For process and service optimization, the agreed bottles may be placed on the table upon arrival; the customer agrees to this. The serving of alcoholic beverages is subject to applicable youth protection regulations; the restaurateur is entitled to request age verification.
10.5 Ticket obligation: Access to the event – and thus also to reserved areas of participating restaurateurs – is generally only possible with a valid ticket according to section 5.3 unless otherwise explicitly stated in the reservation. If a ticket obligation exists, a corresponding ticket according to point 5 is automatically added to the shopping cart for each seat reservation. A seat or table reservation can only be completed together with the corresponding ticket purchase in these cases.
10.6 Payment processing/direct debit authorization: By providing PayPal or credit card details, the customer expressly consents to the direct debit of all incurred prices and fees – especially deposits/minimum consumption amounts, ticket prices, processing fees, and any cancellation fees (according to section 10.10) – without further consultation with the CUSTOMER using the chosen payment method's direct debit procedure. IXXALP only receives the processing fee as mediator, which is separately indicated before the reservation. The amount agreed for minimum consumption is transferred directly to the respective restaurateur via the booking platform.
10.7 Customer data/number of guests: The CUSTOMER must provide their full name (company), address, email, and phone number, as well as the exact number of guests to be catered for and the scope of the desired catering for all reservations. These data constitute an essential part of the contract and are the basis for invoicing the CUSTOMER. Exceeding the reserved number of persons is not permitted. The agreed number of guests is used as the basis for billing as the minimum number. In case of falling below the agreed number of guests, the cancellation conditions according to section 10.10 apply.
10.8 Billing/consumption: If no other agreement (e.g., flat rate) is made regarding consumption, all consumed drinks and food are invoiced by the restaurateur according to actual consumption and the order value according to the current price list. In addition, the amount stated per person or per table in the booking process is considered binding minimum consumption for each table reservation. The agreed minimum consumption is a binding contractual component and is owed regardless of actual consumption. This minimum consumption amount must be paid by the customer in advance – via credit card or PayPal – via the booking platform (the respective restaurateur receives this amount).
10.9 Deposit/minimum consumption: The restaurateur concludes the catering contract only under the condition that the CUSTOMER pays a deposit equal to the agreed minimum consumption. The deposit is a partial payment on the agreed (catering) fee and is credited as consumption credit on the day of the event.
10.10 Cancellation conditions/flat-rate damages: Partial or complete cancellation by unilateral declaration of the CUSTOMER is only possible against payment of the following cancellation fees:

For all cancellation deadlines, only the start of the White Pearl Mountain Days ("event start") is decisive, not the individually reserved event day. The event start is the first event day according to the published program. All time references are based on local time at the event location (Europe/Vienna). In case of no-show or cancellation from the 9th calendar day before the event start, the amount agreed as minimum consumption and already paid is retained as flat-rate cancellation fee. In this case, there is no claim for refund. The cancellation fee takes into account that the table was blocked for other guests during the reserved period, staff and goods were planned, and short-term replacements are usually not possible. In relation to the table reservation with the respective restaurateur, IXXALP acts as mediator and is not liable for any refund claims against the respective restaurateur. A deposit already paid is credited against the cancellation fees mentioned above.
10.11 Exclusion of withdrawal (FAGG): The services offered by the restaurateur are leisure services within the meaning of § 18 para. 1 no. 10 FAGG, which are provided at a specific time within a precisely specified period. According to § 11 para. 1 FAGG, the CUSTOMER therefore has no right of withdrawal under FAGG.
10.12 Acceptance/expiration of the reservation: The customer and guests undertake to accept the reservation (table) within 30 minutes of the agreed time; otherwise, the reservation expires. Point 10.10 remains unaffected.
10.13 Bad weather/indoor relocation: The restaurateur or IXXALP will inform no later than 4:00 pm the day before on the website www.wpmdays.at and by email whether the event will take place, be relocated, or be held indoors. In case of (indoor) relocation, reservation and minimum consumption remain valid. Section 10.10 applies unchanged.
10.14 Communication: Notifications (including information on relocation or cancellation) are sent to the email address provided during the booking process and published on the website. The customer ensures availability and spam control.
11.1 The data protection information pursuant to Art. 13 GDPR of IXXALP is available at https://wpmdays.at/en/dataprotection. IXXALP reserves the right to change the information on data processing and adapt it to actual conditions within the legally permissible scope. The information on data processing does not become part of the contract.
11.2 Image, sound, multimedia recordings: It is pointed out that photos and/or videos are taken during IXXALP events, especially during the White Pearl Mountain Days. The CUSTOMER acknowledges that photographs and video material on which the CUSTOMER is depicted may be published for press reporting and in various (social) media, publications, and on the website https://wpmdays.at/en. Further details are available in the data protection information at https://wpmdays.at/en/dataprotection.
11.3 The customer is obliged to notify IXXALP of changes to their contact details (e.g., email, address) as long as the subject matter of the contract has not been fully fulfilled by both parties. If notification is omitted, statements are deemed to have been received if sent to the last known address.
12.1 Offsetting any counterclaims against claims of IXXALP, for whatever reason, is not permitted.
12.2 Section 12.1 does not apply to consumer transactions. In consumer transactions, the set-off of any open counterclaims against claims of IXXALP is not permitted unless IXXALP is insolvent or the mutual claims are legally related, have been judicially established, or acknowledged by IXXALP.
13.1 The place of fulfillment is the registered office of IXXALP.
13.2 Austrian law applies. The applicability of the UN Sales Convention is expressly excluded.
13.3 The contracting parties agree to Austrian domestic jurisdiction. The court with local jurisdiction at the registered office of IXXALP is exclusively competent to decide all disputes arising from this contract.
13.4 Section 13.3 does not apply to consumer transactions, but § 14 KSchG applies.
Should provisions of this contract be or become legally ineffective, invalid, and/or void during its term, this shall not affect the legal validity and enforceability of the remaining provisions. The contracting parties undertake in such a case to replace the legally ineffective, invalid, and/or void (have become legally ineffective, invalid, and/or void) provision with one that is legally effective and valid and corresponds in its economic effect to the replaced provision as far as possible and legally permissible.
